Privacy Policy

  1. General Provisions
    1. The following terms are drafted in the mascoline gender for convenience purposes only, but are equally binding on both genders.
    2. This policy constitutes the privacy policy of Mind U Ltd. (P.C. 513060343), whose registered office is at 22 Raool Wallenberg Street, Tel Aviv (hereinafter: “the Company”), which operates the website at the address: www.mindu.co.il (hereinafter: “the Website”).
    3. This Privacy Policy applies to individuals who submit their curricolum vitae (CV) to us, either through the Website or through third parties (hereinafter “Candidate” or “Candidates”), as well as to individuals who visit the Company’s Website (hereinafter “Visitor” or “Visitors”), and to any other person who is granted access to the Company’s services.
    4. It is hereby clarified that this Privacy Policy applies to all media through which the Website and the Company's services are operated (such as the Internet, including LinkedIn, Facebook, and other social networks, or any other business page operated by the Company), and it also applies to any information provided to us in telephone conversations.
    5. Please read the following terms carefolly. The services appearing and offered on the Website, including, the screening and engagement process with candidates for the purpose of their employment by the Company or by third parties (hereinafter: “the Service” or “the Services”), are conditional upon your approval of this Privacy Policy without modification.
    6. This Privacy Policy shall become effective by using or visiting the Website, and/or by your acceptance of the policy’s terms, and it shall remain in effect for an indefinite period.
    7. By visiting the Website and/or accepting the terms of the policy, the Visitor or Candidate hereby expressly consents to the collection, storage, use, and transfer of the information as described by the Company in this Privacy Policy.A Candidate who is also a Visitor shall be subject to the terms applicable to a Visitor, in addition to the terms applicable to a Candidate.
    8. The headings in this Privacy Policy are for convenience only and do not serve as an explanation or interpretation of the clauses that constitute the Privacy Policy.
 
  1. The Information the Company Collects and How the Company Collects It
    1. The Company collects information about Visitors and Candidates through the use of the Company's services by the Candidate or Visitor, for example, when a Candidate submits a CV to the Company (hereinafter “Personal Data”).
    2. In addition, the Company collects information about a Visitor visiting the Company's Website, for example, an IP address (hereinafter “Usage Data”). Personal Data and Usage Data shall hereinafter be referred to collectively as: “Information” or “the Information”.
    3. The following types of information may be collected, stored, and used through your visit to the Website and/or use of the Services:
      1. Information about your visits to and use of the Website and/or the Service, including the referral source, length of visit, page views, and your navigation paths on the Website.
      2. First name and last name, phone number, email, address, and other details entered when contacting our customer service.
      3. Information about your education, employment experience, demographic data, and the like, by means of the CV you send to us, whether through the Website, via email, or through third-party sites.
      4. The information you enter while using the Services on our Website.
      5. Information generated while using our website, including when, how much, and under what circumstances you use it, including, without limitation, while using the Services.
      6. Information contained in any messages you send to us by email or through the Website or in using our Services, including the content of the message and its metadata.
      7. Any other type of personal information you send to us.
Before you disclose to us the information of another person, you must obtain that person's consent both for the sharing and for the processing of that personal information in accordance with this policy.      
  1. How the Company Collects the Information:
    1. The Company collects information through the CVs submitted to it by job candidates, as well as any accompanying documents sent by the candidate themselves.
    2. Through direct inquiries from candidates to the Company via social media platforms such as LinkedIn, Facebook, and the like.
    3. Through direct inquiries from the Company to candidates via social media platforms such as LinkedIn, Facebook, and the like.
    4. Through meetings with candidates at conferences, networking events, and other marketing or communication channels.
    5. The information is collected when a Candidate uses the Service or when a Visitor visits the Website, when a Candidate or Visitor contacts the Company's customer service, sends the Company messages and/or documents through various means of communication such as emails and/or phone calls, or contacts the Company by other means.
    6. Forms/Surveys/Feedback – Visitors and/or Candidates may participate in and fill out forms/surveys/feedback on the Website and/or while using the Service, in which they can provide the Company with their name and email addresses.
    7. Cookies – Like many other websites, the Company may use "Cookies" to collect data in order to assist Candidates and Visitors and to provide them with a more personal experience in using the Website and the Service. A cookie is a file containing an identifier (a string of letters and numbers) that is sent by a web server to a web browser and is stored by the browser. The identifier is then sent back to the server each time the browser requests a page from the server. Candidates and Visitors can always disable cookies through their browser or by using a dedicated add-on installed on the Website. If Candidates or Visitors disable cookies, some (or all) of the features and functionality of the Services and/or the Website may not be available to the Candidates or Visitors who have chosen to disable the function. Candidates and Visitors expressly agree to the Company's use of cookies, as detailed above.
    8. The Company may also use other technologies (such as "web beacons") to collect anonymous, non-identifiable information. Such information may include the IP address of the Candidate and/or Visitor, browser type, and information about the use of the Website.
    9. Through any other data that is generally stored in website logs.
  1. No Obligation to Provide Personal Information
For the avoidance of doubt, it is clarified that you are under no legal obligation to provide the Personal Information. However, without providing the Personal Information required for registration, it will not be possible to make foll use of the Services, and it is likely that it will not be possible to receive services (all or part of them, as the case may be) from us.
  1. How the Company Uses the Information
The Information will be used for the purposes specified in this policy, in accordance with applicable laws and regolations:
  1. Your recruitment process for a position at the Company or your placement with third parties (including for screening procedures, aptitude tests, personal interviews, and the like).
  2. Identifying you and verifying your details.
  3. Improving and enhancing the functionality, design, and quality of the Website and/or the Service.
  4. Managing our Website and/or Service and/or business.
  5. Providing offers and details about employment opportunities.
  6. To enable you to use the Services as they are available or detailed on our Website.
  7. Performing internal analyses, analytics, and segmentations of statistical information regarding the information of Candidates and Visitors, including its transfer to a third party (but such third party will not be able to identify any individual user from the information).
  8. Contacting you for the purpose of providing the Service, including, handling inquiries and requests submitted by you or concerning you and related to our Website.
  9. To keep our Website secure and prevent fraud.
  10. Verification of compliance with the terms of use that govern the use of the Website.
  11. Notifications regarding updates made to the terms.
  12. Improving, monitoring, and tracking the Services, the use of the Services, and the Website.
  13. The Company may publish on the Website testimonials from Candidates and Visitors which may contain personally identifiable information. By providing such a testimonial to the Company, Candidates and Visitors hereby consent to the Company publishing the Candidate's and/or Visitor's name along with the Candidate's and/or Visitor's testimonial.
  14. Other legitimate uses to the extent that they are consistent with theCompany's purposes as detailed in this policy.
  1. Disclosure of Information
    1. We may disclose the Information to any of our employees, officers, insurers, professional advisers, agents, suppliers, or subcontractors as reasonably necessary for the purposes set out in this policy.
    2. We may disclose the Information to any member of our group of companies (for example, subsidiaries or affiliated companies) as reasonably necessary for the purposes set out in this policy.
    3. We may share your Personal Data with our clients for the purpose of assessing your suitability for the position to which you are applying, and for completing yourrecruitment as a service provider or employee of the Company.
    4. In addition, we may disclose the Information to a third party as follows:
      1. The Company may disclose general or non-identifiable information to potential business partners, investors, or the public, but the Company will not disclose, without the specific consent of the Candidate or Visitor, identifiable information to third parties, except as expressly stated otherwise in this policy.
      2. The Company may use and share information with certain third parties who assist the Company in operating the Website and/or providing the Services, including services to the Company's clients (e.g., cloud providers, mailing distribution service providers, CRM (Customer Relationship Management) providers, support ticket providers, and other similar service providers). Such third-party providers will have access to the information necessary to perform their functions, but they will not be permitted to use it for other purposes.
      3. The Company may share information with third parties in order to comply with any applicable law or regolation, in any ongoing or potential legal proceedings, to prevent fraud or actual harm, to reduce credit risk, to ensure the security of the Service and/or the Website, and where the Company believes that disclosure is necessary to establish, exercise or defend our legal rights.
      4. If the Company is involved in any merger transaction, acquisition/sale, or any other type of sale of assets, its business, shares, and the like, or other commercial transaction where user or candidate details are required, whether it is a binding or potential transaction, the Company may transfer allinformation in connection with such a transaction.
    5. To any person who we reasonably believe may apply to a court or other competent authority for disclosure of the information where, in our reasonable opinion, such court or authority woold be reasonably likely to order disclosure ofthat information.
  2. Database
    1. Information of Candidates and Visitors collected by us as detailed in this policy will be stored in the Company's databases which will be held by the Company and/or by anyone on its behalf.
    2. All information collected by the Company is stored in the cloud, whose servers are located in Israel and/or abroad. The use of the information will be in accordance with the purposes of these databases and as stated in this policy and/or in the specific policy of the service you are using.
    3. Without derogating from the foregoing, the Company will comply with the provisions of the Protection of Privacy Law, 5741-1981, and the regolations thereunder, whether there is a need for registration and operation of a database or not.
  3. International Data Processing and Transfers
Information that we collect may be stored, processed in, and transferred between any of the countries in which we operate in order to enable us to use the information in accordance with this policy. Your consent to the terms of this policy (whether by visiting the Website or otherwise) also constitutes your consent to the transfer of your information outside the country's borders, provided that your rights as detailed in this policy are not prejudiced as a resolt of such transfer.
  1. Retention and Storage of Information
    1. This section sets out our data retention policies, which are designed to help ensure that we comply with our legal obligations regarding the retention of Information.
    2. The Company will retain the Personal Data of Candidates and Visitors as long as it is necessary for the purposes detailed in this policy and to provide the Services.
    3. The Company will retain and use the Personal Data of Candidates and Visitors to the extent necessary to comply with the Company's legal and statutory obligations (for example, if the Company is required to retain such data to comply with applicable laws and regolations), to resolve and defend against legal disputes, and to enforce the Company's legal agreements and policies.
    4. The Company will also retain the Information for internal analysis purposes. Usage Data is generally retained for a shorter period, except where this data is used to strengthen the security or to improve the functionality of the Service, or in the event that the Company is legally obligated to retain this data for longer periods.
    5. The duration of the retention periods will be determined taking into account the provisions of the law, the type of information collected, and the purpose for which it was collected, taking into account the requirements of the law.
    6. The cloud servers where we store, process, and maintain the Information are located in Israel and are managed by third parties.
    7. The storage of the Information as aforesaid is carried out in accordance with the standards specified in this Privacy Policy, using security measures that are customary in the market, and subject to the provisions of the law.
    8. Non-personal data and anonymous statistical data may be retained by us without limitation.
    9. Notwithstanding the other provisions of this section, we will retain documents (physical or electronic) containing information:
      1. For the purpose of managing our business in the ordinary course;
      2. As required of us by law;
      3. If we believe that the documents may be relevant to any ongoing or potential legal proceedings;
      4. In order to establish, exercise, or defend our legal rights (includingproviding information to others for the purposes of fraud prevention).

    1. The Company uses standard security measures to protect the Information from unauthorized access or unauthorized alteration, disclosure, or destruction. These measures include internal reviews of the Company's information collection, storage, and processing practices and security measures.However, no method of transmission of information over the Internet, or method of electronic storage, is 100% secure. Therefore, the Company cannot guarantee the absolute security of the Information.
    2. The Company restricts access to the Information to its employees, service providers, partners, and agents for whom the Information is essential for the purpose of performing the Services. These parties are bound by confidentiality obligations, and the Company requires them to agree to use the Information solely for the purpose for which it was transferred to them in the first place, and in strict accordance with this policy.

Please note that we shall be entitled to demand one or more means of identification from you (at our sole discretion) such as a copy of your identity card in order to verify that the request came from the relevant data subject.

    3. In the event that the request is denied, you have the right to appeal our decision in the manner prescribed by law.

If the Candidate or Visitor enters personal information (or any other information) on one of those websites, such information is subject to the privacy policy of that third party. The Company encourages Candidates and Visitors to carefolly read the privacy policy of any website that the Candidates and Visitors visit.
  1. Children's Privacy Policy
The Services are not intended for persons under the age of 18. If you are under the age of 18, you are not permitted to use the Services and do not provide us with any information. We reserve the right to access and verify any information collected from you by us. In the event that we become aware that a person under the age of 18 has shared any information, we will discard such information.     3. Candidates and Visitors shoold check this page from time to time to ensure they understand all the changes made to this policy. We may, but are not obligated to, notify you of changes to this policy by email or through the messaging system within our Service.The continued use of the Service by the Candidate or the continued use of the Website by the Visitor after the effective date of any such change shall be deemed as their consent to the amended Privacy Policy as aforesaid.
    4. All disputes arising from this policy shall be subject to the laws of the State of Israel and to the exclusive jurisdiction of the competent courts located in the city of Tel Aviv-Jaffa. The parties agree to the exclusive jurisdiction and venue of these courts.However, nothing shall prohibit either party from taking any action in any court of competent jurisdiction to obtain interim relief or to protect or enforce its intellectual property rights.
